Rent Local – Terms of Service

These Terms of Service (“Terms”) govern all reservations, rentals, storage, listing, and use of equipment made available by Rent Local LLC, a North Carolina limited liability company (“Rent Local,” “we,” “us,” or “our”). By renting equipment, listing equipment, storing equipment, or otherwise using Rent Local’s services, you agree to be legally bound by these Terms.
1. Company & Governing Law
Rent Local LLC is formed in the State of North Carolina. All matters arising under these Terms shall be governed exclusively by the laws of the State of North Carolina. Any dispute shall be resolved exclusively through binding arbitration in Currituck County, North Carolina, and users waive the right to participate in any class action or class-wide proceeding.

2. Nature of Platform & Inventory Ownership
All rentals are between the Renter and Rent Local LLC. Equipment available through Rent Local may be owned either by Rent Local or by independent community item owners (“Listers”).
Rent Local provides rental facilitation, payment processing, storage coordination, and operational management services. Rent Local retains a 50% commission on rentals of lister-owned items.
Listers are solely responsible for the safety, mechanical condition, legality, maintenance, and fitness of their listed equipment. Rent Local assumes maintenance responsibility only for equipment it directly owns.
Rent Local does not guarantee rental frequency, revenue, demand levels, or income to any Lister.
3. Storage & Custody Disclaimer
Storage of equipment at any Rent Local hub, including Pinnacle Storage in Moyock, North Carolina, is incidental to the rental service. Rent Local is not an insurer, warehouseman, or guarantor of property.
To the maximum extent permitted by law, Rent Local disclaims any duty as a bailee beyond reasonable commercial care. Rent Local shall not be liable to any Lister for theft, vandalism, normal wear and tear, mechanical failure, market depreciation, loss of future rental income, acts of third parties, or events beyond its reasonable control.
Rent Local’s total liability to any Lister shall not exceed the total commission retained by Rent Local from the specific rental transaction giving rise to the claim, unless otherwise required by law.
4. Eligibility
Renters must be at least twenty-one (21) years of age and present valid government-issued photo identification at pickup. Rent Local reserves the right to refuse service at its sole discretion.
5. Reservations & Payment Authorization
Reservations may be made online. Certain items, including those priced at or above $100 per day, may require online prepayment at Rent Local’s discretion.
A $1 handling fee applies per rental transaction. Certain items may include additional disclosed cleaning, handling, or maintenance fees.
By reserving an item, the Renter expressly authorizes Rent Local to charge the card on file for rental charges, late fees, cleaning fees, repair costs, replacement value, administrative costs, downtime/lost rental income, cancellation or no-show charges, and any other amounts due under these Terms.
6. Late Returns
Failure to return equipment at the agreed time will result in charges equal to the standard daily rental rate for up to three (3) additional days. Thereafter, late returns will be charged at 150% of the daily rental rate until returned.
Failure to return equipment may be treated as unlawful conversion or theft and may be reported to law enforcement.
7. Geographic & Use Restrictions
Equipment must remain within a twenty-five (25) mile radius of pickup unless prior written approval is obtained. Subleasing, lending, or transferring possession to any third party is strictly prohibited.
Equipment may not be used unlawfully, recklessly, commercially without approval, or in a manner inconsistent with its intended purpose.
8. Assumption of Risk
Renter acknowledges that tools, machinery, and rental equipment carry inherent risks including property damage, serious bodily injury, or death. Renter voluntarily assumes all risks associated with transport, possession, and operation of rented equipment.
Rent Local provides no insurance coverage to Renters, Listers, or third parties.
9. Inspection & Responsibility
Renter agrees to inspect equipment at pickup and accepts it in its present condition unless defects are reported immediately. Failure to report visible defects constitutes acceptance.
Renter is responsible for all loss, theft, destruction, or damage occurring during the rental period regardless of fault.
Renter is responsible for full listed replacement value in the event of total loss.
10. Damage, Replacement & Downtime
Rent Local reserves sole discretion to determine damage, repair costs, replacement costs, administrative expenses, and lost rental income (“downtime”) while equipment is unavailable.
Renters are contractually responsible for all damage and associated costs. Rent Local retains full recovery rights against the responsible Renter.
For lister-owned equipment, Rent Local may, at its sole discretion, advance partial or full payment to the Lister prior to final recovery. Any such advance does not create a guarantee of reimbursement and does not constitute insurance coverage.
11. Owner Protection & Damage Recovery
For equipment owned by community Listers, Rent Local administers rental transactions and handles damage assessment and recovery directly with the Renter. Renters are contractually responsible for all loss, damage, theft, misuse, and full replacement value during the rental period.
In the event of damage, Rent Local will evaluate the condition of the item and determine appropriate repair or replacement costs. Rent Local will pursue recovery from the responsible Renter for repair costs, replacement value, administrative expenses, and downtime where applicable.
If a Renter fails to pay confirmed damages, Rent Local may, at its sole discretion, advance partial or full payment to the Lister prior to final recovery. Any such advance does not create an insurance obligation or guarantee of reimbursement.
Rent Local implements identity verification, payment authorization, and card-on-file procedures designed to reduce risk and support Listers; however, all rental activity involves inherent risk, including wear and tear and potential damage.
12. Limitation of Liability
To the fullest extent permitted by law, Rent Local’s total aggregate liability arising from any rental or listing activity shall not exceed the total rental fees paid for the specific transaction giving rise to the claim.
Rent Local shall not be liable for indirect, incidental, consequential, punitive, or special damages, including lost profits, business interruption, personal injury, or property damage.
13. Indemnification
Renter agrees to indemnify, defend, and hold harmless Rent Local LLC, its members, managers, employees, contractors, Listers, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including attorney’s fees) arising from use or misuse of rented equipment, injury or death, property damage, violation of these Terms, or transport and operation of equipment.
14. Surveillance & Access Control
Storage hubs may utilize video surveillance. Access is permitted only during scheduled appointments. Unauthorized entry may constitute trespassing and may be prosecuted.
15. Account Termination
Rent Local reserves the right to suspend or terminate access to services at any time for policy violations, safety concerns, suspected fraud, misuse, or other operational risk.
16. Modification of Terms
Rent Local reserves the right to modify these Terms at any time. Continued use of services after modification constitutes acceptance of updated Terms.

18. Customer Content & Image Use Authorization
By renting equipment or using our services, you grant RENT LOCAL the right to capture, use, reproduce, and display photographs, videos, or other media that may include rented equipment and/or images submitted by you.
This includes, but is not limited to:
- Photos or videos taken by our team during pickup, delivery, or use of equipment
- Images submitted by customers for reviews, testimonials, or documentation
- User-generated content shared via email, text, website uploads, or social media
By providing or appearing in such content, you agree that:

Usage Rights
You grant RENT LOCAL a non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, edit, publish, and distribute Customer Content for marketing, advertising, website, social media, and promotional purposes. -
No Compensation
You understand and agree that no compensation will be provided for the use of Customer Content. -
Representation
You confirm that you own the rights to any content you submit or have obtained all necessary permissions from individuals appearing in the content. -
Waiver of Claims
You waive any right to inspect or approve the final use of the content and release [Your Company Name] from any claims related to its use. -
Opt-Out Option
Customers may request removal of specific images by submitting a written request to rentlocalusa@gmail.com, and we will make reasonable efforts to comply.
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
By reserving, renting, or listing equipment with Rent Local, you acknowledge that you have read, understood, and agreed to these Terms of Service.
